Welcome to Joodaic.com. These Terms of Service ("Terms") govern your access to and use of the Joodaic website, application, and services ("Service"). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy.


1. General Terms

1.1 Definitions

  • Service: The website https://joodaic.com and application collectively referred to as "Joodaic".
  • Company, Operator, We, Us, Our: Joodaic.com.
  • User: Any individual or legal entity accessing or using the Service.
  • Seller: A user listing goods for sale.
  • Buyer: A user purchasing goods.
  • Order: A transaction initiated on the platform.

1.2 Acknowledgment

By using the Service, users confirm they are of legal age in their jurisdiction and agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not access the Service.

1.3 Governing Law & Arbitration

These Terms are governed by the laws of New York, USA. Any disputes will be resolved via binding arbitration under the AAA Rules, in New York and in English. No class actions are permitted.

1.4 Severability & Waiver

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. Failure to enforce any right or provision shall not constitute a waiver.

1.5 Indemnity

Users agree to indemnify and hold harmless Joodaic, its affiliates, and its officers from any claims, damages, or expenses arising from their content, conduct, or use of the Service.

1.6 Platform Communication & Transaction Integrity

All communication and transactions regarding listings must remain on the Joodaic platform. Users may not use the platform to solicit or redirect sales externally. Violations may result in account suspension or removal.

1.7 Account Responsibilities

Users are responsible for maintaining the confidentiality of their account credentials and for all activity that occurs under their account. Joodaic may suspend or terminate accounts found to be using false information or engaged in unauthorized access.


2. Terms for Buyers

2.1 Buyer Responsibilities

Buyers agree to:

  • Provide accurate information.
  • Not engage in fraudulent activity.
  • Respect each seller’s return or refund policy.

2.2 Returns and Refunds

Each seller on Joodaic sets their own return and refund policy. Please review it before purchasing.

If a product arrives damaged or not as described, the seller is responsible for resolving the issue. Buyers must contact the seller first. Only if the seller does not respond or resolve the issue may the buyer contact Joodaic to step in.

2.3 Purchase Protection

Joodaic may, at its discretion, provide assistance for cases involving undelivered, damaged, or misrepresented goods. However, protection is evaluated on a case-by-case basis.

If an issue arises with an order, customers should contact the seller directly as a first step. If unresolved after 48 hours, a case may be opened with the platform. If eligible, a full refund will be issued.

Disputes are reviewed on a case-by-case basis. Joodaic reserves the right to issue refunds, withhold payouts, or remove listings.

2.4 Chargebacks

Before initiating a chargeback through your payment provider, you must attempt to resolve the issue with the seller and, if unsuccessful, with Joodaic. We reserve the right to dispute any chargebacks and may pass related fees and losses to the responsible seller. Fraudulent chargebacks may result in account suspension.


3. Terms for Sellers

3.1 Seller Responsibilities

Sellers agree to:

  • Accurately describe and deliver goods.
  • Ship orders within the timeframe stated in their listings.
  • Comply with local and international laws.
  • Respond to buyer inquiries in a timely manner and maintain clear, respectful communication.
  • Fulfill all orders placed through Joodaic.
  • Keep all buyer communication and transactions within the platform.

Joodaic does not conduct background checks or endorsements of any seller. Sellers are responsible for the accuracy, legality, and reliability of all information they provide, and for adhering to any policies they publish on their shop or listings.

We reserve the right to investigate and act against fraudulent or abusive behavior, including suspension or termination.

3.2 Fees and Commissions

We charge a commission on each completed sale. All printing, shipping, and related costs are the seller’s responsibility. In cases of customer disputes, Joodaic may charge the seller for a refund if we believe one is warranted. Sellers will always be notified before any such charge.

We reserve the right to update our fee structure and policies with prior notice.

Platform fees paid by sellers or buyers are non-refundable, including in cases where content is removed or disputes arise, unless otherwise required by law or explicitly stated in these Terms.

3.3 Content Guidelines

Sellers must not post content that is illegal, harmful, plagiarized, or otherwise objectionable. Diversion of transactions to external channels is strictly prohibited. Violations may result in account suspension.

3.4 Intellectual Property

Sellers must own or have the rights to any content they upload. Repeat copyright infringers will have their accounts terminated.

By uploading content, sellers grant Joodaic a non-exclusive, royalty-free license to use, display, and promote their content for the purpose of operating and marketing the platform.

To request removal of infringing content, contact us with the copyright details. We follow a standard notice-and-takedown procedure.

If you are a copyright owner and believe your work has been infringed, please provide a written notice including: (i) your signature; (ii) a description of the copyrighted work; (iii) the URL of the infringing material; (iv) your contact details; (v) a good faith belief that use is unauthorized; and (vi) a statement under penalty of perjury that your claim is accurate. We will act promptly to address valid complaints.


4. Disputes and Limitations

4.1 Between Users

Joodaic is not a party to agreements between buyers and sellers. We may assist in disputes but do not guarantee resolution. Users are encouraged to resolve matters independently first.

4.2 Limitation of Liability

Our liability is limited to the greater of $100 or the amount you paid through the Service. We are not liable for indirect or consequential damages.

4.3 Disclaimer

The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee uninterrupted service or error-free functionality.

While we take reasonable steps to safeguard data, we do not guarantee content backups. Users should maintain their own copies.
